Together with our affiliates (“eCapital,” “we” or “us”) we may collect such information and data from you, including but not limited to on ecapital.com, from mobile and desktop applications you download from us, when you apply for a job with us, in our online client portals, or when you interact with us via email, text (SMS, MMS), telephone, social media, fax, mail, and any other messages between you and eCapital.

Collection of Your Personal Information

We collect several types of information from and about users of eCapital services:

  • Directly from you when you provide it to us;
  • Automatically as you navigate through our website; and
  • From third parties, for example, our business

Your Survey Responses We collect data you share through surveys. If a third-party offers a survey, the third party’s privacy notice also applies to the collection, use, and disclosure of your data. Necessary for our legitimate interests in developing our products and services and conducting research about your opinion of current services or of potential new services that may be offered.
Your User Contributions To be published or displayed on public areas of our website or transmitted to other users of our website. Necessary for our legitimate interests (for operating our business) and performance of our contract with you.
Job Applicants If you apply for a job or provide us with your personal information for purposes of employment, we collect information needed to process your application. This may include your social security number and any information on your resume. Providing this information is required for employment. In some contexts, we are required by law to collect data about applicants. We also have a legitimate interest in using data to evaluate your application or consider you for other positions. If you become an employee, we will provide you with a separate privacy notice that explains how we collect, use, and share additional data about our employees.
Mailing Lists (SMS) When you sign up for our text messaging lists, we collect your contact information. Where required by law we will ask for your consent. We do not share your mobile number with our affiliates or with third parties for their own marketing purposes, unless you have consented to have your information shared for the purpose of receiving marketing from the third party.
Mailing List (Email or Mail) When you sign up for our mailing lists, we collect your contact information. We have a legitimate interest in sharing information about our products and services. Where required by law we will ask for your consent before communicating with you.
Use of our App We collect your username and password, as well as your interactions, when you use our app. We have a legitimate interest in understanding how you use our app. Where required by law, or by a mobile platform, we base the use of third-party tracking technologies upon consent. Users should go the settings menu in their mobile device for more information about changing App preferences.

Providing personal information is voluntary, but if you choose not to provide us certain information, we may not be able to offer employment, certain products and services, or access to certain online features.

Sensitive Information Disclosure

We collect the following categories of sensitive personal data (as defined under relevant laws): Social Security number, driver’s license, state identification card, or passport number; account log-in, financial account in combination with any required security or access code. We collect this data to process transactions, comply with laws, manage our business, or provide services. Note that we do not use such data for any purposes that are not identified within Cal. Civ. Code § 1798.121.  We do not “sell” or “share” sensitive personal data for cross-context behavioral advertising, although we may transfer it to third parties when you instruct us to do so.  When that occurs, third parties will use it for the purposes indicated in their privacy notices.

How We Use Your Personal Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To provide you with information, products, or services that you request from us.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

Note that we may transfer and/or store your personal information to or from the United States, United Kingdom, and Canada pursuant to these purposes.

To the extent we store and use deidentified personal information, we will not try to reidentify the information, except to test our deidentification methods.  If we share deidentified information we will obligate the recipient not to try to reidentify the data.

How We Disclose Your Information

eCapital does not sell, rent or lease personal information; however, we may disclose or share personal information as outlined in the chart below.

  • Subsidiaries and Affiliates: We may share data with our affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control).
  • Service Providers: We may share your data with service providers. Service providers may help us to run our website, conduct surveys, provide technical support, process payments, fulfill orders, and more.
  • Buyers or Other Successors: If a company acquires or enters negotiations to acquire, our company, business, or assets, we may share data with that company.
  • Government, Regulatory Bodies, or Other Disclosures Without Your Consent: We may share data to cooperate with law enforcement, participate in a legal process, or for legal compliance. We may share your data to establish or exercise our rights, to defend against legal claims, to investigate, prevent, or act on possible illegal activities, threats to safety of person or property, or a violation of our policies. Your Privacy Rights

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with control over how your data is used and/or disclosed. Opt-Out

  • Promotional Emails from You can opt out of receiving promotions of our products or services to your email address or other contact information by following the unsubscribe instructions at the bottom of those emails, checking the relevant box on the form on which we collect your data, or logging into our website and adjusting the user preference boxes in your account profile within our online client portals. You can also reply to any promotional email asking to be omitted from future email distributions,. Please note that this opt-out mechanism does not apply to information provided to eCapital as a result of a transaction with eCapital, warranty registration, product service experience or other transactions.
  • Promotional Text Messages. If you get a text message from us that has promotional content, you can opt out of future text messages by replying “STOP.”
  • Website Targeted Advertising If you do not want us to use information that we collect or that you provide to us for online targeted advertising, you can opt-out by clicking the cookie settings link here or the “Your Privacy Choices” link on our homepage. Note that if you change browsers or devices, or if you clear your browser’s cache, you may need to click the link again to apply your preference. You may opt-out of other forms of targeted advertising, if applicable, by submitting a request as described below. We recognize browsers as a valid opt-out request where required by applicable law. Please note that the GPC will apply only to your current browser. We do not recognize the “Do Not Track Signal.” If there is a conflict between the GPC signal and a manual choice that you have made on our website regarding targeted advertising, we will honor your manual choice.
  • App-Based Targeted Advertising. You may opt-out of App-based targeted advertising (e.g., SDKs with advertising partners) by going to the settings menu in your mobile device.

Know/Access and Port Your Information

You can review your personal information by logging into our website and visiting your account profile page within our online client portals.

You may also request access to your information or confirmation that we process data about you by contacting us via the information in the Contact Information section. In certain limited cases, you may ask to receive access to your data in a portable, machine-readable form.  We will do our best to accommodate your access request as specified.

Correct or Rectify Your Information

You may request the correction of inaccurate or incomplete data if you find that it is not possible to change on your account profile. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. We may also keep historical data in our backup files as permitted by law.

Delete or Erase Your Information

You may request the deletion of your information, subject to certain exceptions, of any personal information that you have provided to us. If required by law, we will grant such a request, but note that in many cases, we must keep your personal information to comply with legal obligations, resolve disputes, enforce agreements, or for other business purposes. Please also note that we may not be able to delete your personal information except by also deleting your user account.

Objection to or Restriction of Certain Processing

In certain circumstances, you may object to the processing of your personal data, or ask that we restrict processing of your personal data.

Revocation of Consent

Where we process your personal data based upon consent, you may revoke consent. Note, if you revoke consent for processing personal data, we may no longer be able to provide you some types of services.

Not all the rights above are absolute, and they do not apply in all circumstances. We may limit or deny a request because the law permits or requires us to. We will not discriminate against individuals who exercise a privacy right.

Submitting Requests

You may exercise the above rights through our online portal or by contacting us via the contact information below. If you disagree with our denial of a request, you may appeal our decision by contacting us with the subject line “Appeal.”

We will require you to prove your identity when making most types of requests. We may verify your identity by phone or email. Depending on your request, we will ask for information such as your name, the service or product used, or the date of your last transaction with us. We may also ask you to send us a signed declaration confirming your identity.

Authorized Agent

In some circumstances, you may designate an authorized agent to exercise rights on your behalf. If you have been given permission to act on another individual’s behalf to submit a Privacy Rights request, you must attach a copy of a completed Authorized Agent Designation Form which shows that you may act on another’s behalf.

Children’s Privacy

Our website is not designed for use by individuals under the age of 18. eCapital does not knowingly collect, sell, or share personally identifiable information from children under the age of sixteen (16). If you have concerns relating to the collection of personal information from minors, please contact us at [email protected] or send a letter to the address included in the Contact Information section at the end of this Notice.

Security and Retention of Your Personal Information

The security of your personal information is important to us. Please remember, however, that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your personal information from unauthorized access, use or disclosure, we cannot guarantee its absolute security. If we are required to inform you about a security incident, we will do so electronically, in writing, or by phone, as the law permits.

As you engage with our online client portals, or other portions of our service that may require registration and login processes whereby you will be provided a unique User ID and for which you will be required to create a password, this becomes your “user login” information.

You are responsible for maintaining the confidentiality of any user login information and for all activities related to your user login. By using our online client portals, you agree to notify us immediately if there is any unauthorized use of your user login information.

We keep your personal data for only as long as necessary to fulfill the purposes in this Notice unless a longer retention period is required or permitted by law. This includes the purposes of satisfying legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the data. We also weigh the potential risk of harm from unauthorized use or disclosure of the data, the purposes for which we obtained the data and whether we can meet those purposes through other means, as well as applicable legal requirements.

Transmission of Data to Other Countries

As a multi-national company, we send data between and among our affiliates. As a result, we may process your data in a country with less stringent privacy laws than the laws in the country that you reside. Where possible, we treat personal data using the same privacy principles that guide the law of the country in which we first receive your data. By submitting your personal data to us you agree to the transfer, storage, and processing of your data in a country other than your country of residence including, but not limited to, the United States. Changes to this Notice

eCapital will occasionally update this Privacy Notice to reflect company and customer feedback. If we make changes to this Notice, we will publish the full Notice on this page including the effective date.  If changes are material, we will notify you by email or other appropriate means as required by law. Also, if changes are material, the Notice that was in place when you submitted personal data to us will generally govern that data unless you consent to the new Notice. eCapital encourages you to periodically review this Privacy Notice to be informed of how eCapital is collecting and protecting your information.
