Uses of your Information

Please note that eCapital Commercial Finance Limited (“we”, “us”) will store and process information about you on our computers. Such information will be used by us for training purposes, credit or financial assessments, market and product analysis, making payments, recovering monies and preparing statistics.  In turn this may affect the credit terms clients of ours can offer you.  We may also use such information to prevent fraud, bad debts and money laundering.

Telephone calls between us may be monitored and/or recorded for training and security purposes.

You should note that we may from time to time make searches of your record at our credit reference agency. Your record with such agency includes searches made and information given by other organisations.  The details of our search(es) will be kept by such agency and will be seen by other organisations that make searches.  They may, from time to time, also give to such agency details of your payment performance and any defaults.

This information will be used by the agency and shared with other businesses to:

  • assess applications for credit, and credit related services made by you or members of your household or by any other businesses associated with you;

  •  trace debtors, recover debts, prevent money laundering and fraud;

  • carry out statistical analyses related to credit and financial services;

  • manage your accounts.

We may also give information about you and your indebtedness to:

  • our insurers – so we can quote for and issue any policy or deal with any claims

  • any guarantor or indemnifier

  • our bankers, our financiers or any adviser acting on our behalf – so they can carry out their services to us

  • any business to whom your indebtedness may be transferred – to facilitate such transfer

  • our funders or investors – pursuant to legal agreements.

Basis for Processing

We consider that our processing of personal information is necessary for our legitimate interests in operating Invoice Finance Agreements.

We normally retain personal information for a period of 12 months after termination of an Agreement.

Your right to object

You have a right to object to our processing your information on grounds relating to your particular situation.

Your other rights

You may wish us to amend or delete information we hold, and you have the right to request from us access to and rectification or erasure of personal information or restriction of its processing.

The provision of personal information is neither a statutory nor a contractual requirement, nor a requirement necessary to enter into a contract, so you are not obliged to provide personal information.

Supervisory authority

You also have a right to complain about our use of your information to our supervisory authority, the Information Commissioner’s Office.
